01Agreement to these terms
These terms are an agreement between you and Clouds Line for Information Technology (شركة خطوط السحاب لتقنية المعلومات), a company established in Riyadh, Kingdom of Saudi Arabia — “Clouds Line”, “we”, “us”.
By using this website, engaging our services or using one of our products, you accept these terms. If you use them on behalf of a business, you confirm that you are authorised to bind that business. If you do not accept these terms, please do not use the services.
02Our services
We provide website and mobile app development, hosting, domains, design and marketing services, and we operate the cloud products Basmtak HR and Basmtak Books.
A specific project, plan or subscription may be governed by its own quotation, contract or product terms. Where they differ from this page, the signed contract applies first, then the product's terms, then these terms.
03Accounts
- Give accurate information when you open an account, and keep it up to date.
- Keep your sign-in details confidential. You are responsible for what is done under your account and by the users you invite.
- Tell us promptly if you suspect unauthorised use of your account.
- You must be at least 18 and able to enter into a binding contract.
04Fees and payment
- Fees are those in your quotation, your contract or the plan you chose, and value added tax is added as Saudi law requires.
- Subscriptions are paid in advance for the chosen term and renew as described in the product.
- If a payment is overdue, we may suspend the service after giving you notice.
- Refunds are handled under the quotation, contract or product terms that apply to your purchase, and under Saudi law.
- Charges made by others — domain registries, payment providers, and Meta's charges for WhatsApp messages — are yours to pay and are outside our control.
05Acceptable use
You agree not to use our website, services or products to:
- break any law or regulation that applies to you, or infringe anyone's rights;
- send spam, unsolicited or deceptive messages, or content that is unlawful, abusive or harmful;
- upload malware, or probe, scan or attempt to bypass our security;
- access another customer's data, or overload or disrupt the service;
- copy, resell or reverse-engineer our software without our written permission.
We may suspend or end access for anyone who breaks these rules.
06WhatsApp Business messaging in Basmtak Books
Basmtak Books can send your documents to your customers on WhatsApp through your own WhatsApp Business Account. If you turn this on, you agree that:
- You connect your own WhatsApp Business Account through Meta's Embedded Signup. Messages go out from your number and in your business's name.
- You authorise us to act for you on the WhatsApp Business Platform: to register your number, create and maintain your message templates, send the messages you ask for, and receive their delivery status and your customers' replies.
- You comply with the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and Meta's other terms that apply to you.
- You obtain each customer's agreement (opt-in) before messaging them on WhatsApp, record it truthfully, and respect every request to stop. Basmtak Books does not send without a recorded opt-in, and stops when a customer replies STOP.
- You use the integration only for transactional messages about your own dealings with the customer — invoices, quotes, statements, payment reminders and payment confirmations — and not for marketing or for anything Meta's policies prohibit.
- Meta bills you directly for the messages you send, at Meta's prices.
- Meta decides on template approval, quality ratings, messaging limits and account restrictions. We are not responsible for those decisions or for the availability of WhatsApp.
- You can disconnect WhatsApp at any time in Settings. We may suspend the integration if it is misused or if Meta requires it.
WhatsApp and Meta are trademarks of Meta Platforms, Inc. Clouds Line is an independent technology provider and is not owned or endorsed by Meta.
07Your data
The data you enter into our products belongs to you. We process it to provide the service, on your instructions, and as described in our Privacy Policy.
You are responsible for the data you upload — including the contact details of your own customers and employees — and for having a lawful basis to collect and use it. You can export your data, or ask us for a copy of it, at any time.
08Intellectual property
This website, our software, brands and content belong to Clouds Line or its licensors. We grant you a limited, non-exclusive, non-transferable right to use our products for your business while your subscription is active.
Ownership of the work we deliver to a client under a project — designs, code and content — is set out in that project's contract.
09Third-party services
Our services work with services run by others, such as Meta and WhatsApp, payment providers, domain registries and government platforms. Your use of those services is subject to their own terms, and we are not responsible for their acts, prices or availability.
10Availability and changes
We work to keep our services available and secure, but we do not promise that they will be uninterrupted or free of errors. We may carry out maintenance, and we may add, change or retire features. When a change materially reduces what you paid for, we tell you in advance.
11Warranties and liability
To the extent the law allows, our services are provided as they are, without warranties beyond those stated in your contract.
We are not liable for indirect or consequential loss, including loss of profit, revenue, data or goodwill. Our total liability for any claim is limited to the fees you paid us for the service concerned in the twelve months before the claim arose.
Nothing in these terms excludes liability that cannot be excluded under Saudi law.
12Suspension and termination
You may stop using our services at any time; a term already paid for runs to its end. We may suspend or terminate the service if you breach these terms or do not pay, after giving notice where that is reasonable.
When the service ends, your right to use it ends. Your data is handled as described in our Privacy Policy, including your right to export it and to ask for its deletion.
13Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute that cannot be settled amicably is referred to the competent courts in Riyadh.
14Changes to these terms
We may update these terms. The current version is always on this page with the date it was last updated. If you keep using the services after a change takes effect, you accept the updated terms.
